Role Description

This is a full-time on-site role for an Estate Planning Attorney located in Butte, Helena or Dillon, MT. The Estate Planning Attorney will be responsible for tasks related to estate planning, estate law, probate, estate administration, and succession planning on a day-to-day basis.

Qualifications

• Estate Planning and Estate Law expertise
• Experience in Probate and Estate Administration
• Succession Planning skills
• Strong communication and interpersonal skills
• Attention to detail and organizational skills
• Juris Doctor (JD) degree and Bar Admission in Montana
• Knowledge of local estate planning laws and regulations

Compensation:

Salaried $120,000.00 with billable hour requirement or $80,000.00 with commission structure

Paid time off and holidays.

Key Responsibilities:

• Drafting Legal Documents:
• Creating wills, trusts (revocable and irrevocable), powers of attorney, and other legal instruments to manage assets and healthcare wishes. 
• Providing Legal Advice:
• Offering guidance on estate planning strategies, asset protection, tax implications, and beneficiary designations. 
• Asset Management:
• Assisting clients in understanding and organizing their assets, including real estate, financial accounts, and other holdings, for inclusion in their estate plan. 
• Client Communication:
• Conducting meetings with clients to understand their goals and preferences, explaining legal concepts clearly, and answering questions. 
• Probate and Estate Administration:
• Representing clients in probate court, assisting with the administration of estates, and ensuring the proper distribution of assets according to the client's wishes. 
• Review and Revision:
• Regularly reviewing and updating estate plans to reflect changes in the law, the client's circumstances, or their wishes. 
• Collaboration:
• Working with other professionals like financial advisors, accountants, and insurance agents to provide comprehensive estate planning services. 

Skills and Qualifications:

• Legal Expertise:
• Strong knowledge of estate planning law, including wills, trusts, probate, and tax law. 
• Communication Skills:
• Ability to explain complex legal concepts clearly and effectively to clients and other professionals. 
• Analytical Skills:
• Ability to analyze a client's assets, liabilities, and goals to develop a suitable estate plan. 
• Organizational Skills:
• Ability to manage multiple cases, meet deadlines, and prioritize tasks effectively. 
• Empathy and Sensitivity:
• Ability to understand clients' emotional needs and concerns related to estate planning. 
• Professionalism:
• Maintaining confidentiality, ethical conduct, and building strong client relationships.
